Zumba NXG – Terms and Conditions

Before signing up to a monthly Membership subscription or booking a Drop-In Class or Taster Class with Zumba NXG, please ensure that you have read these Terms and Conditions thoroughly. By purchasing a Zumba NXG Membership subscription or booking a Drop-In Class or Taster Class with Zumba NXG, you are confirming that you have read these Terms and Conditions and agree to be bound by them. These Terms and Conditions constitute a contract between you (the “Client”) and us (“Zumba NXG”).

 

Zumba NXG reserves the right to review and change these Terms & Conditions at any time. We will give you 7 days’ written notice of any changes (or 14 days’ written notice in the case of changes to your Membership fees), and will obtain your consent to such changes prior to any updates.

 

About Zumba NXG

 

Zumba NXG provides group ballet, Zumba, dance fitness and yoga classes (each, a “Class”) in south east London and online via video conference software. Zumba NXG is a sole proprietorship wholly owned and managed by Imogen Lees. The business is based at 141a New Cross Road, London SE14 5DJ. Imogen Lees has Public Liability Insurance by Protectivty Insurance.   1. DEFINITIONS

Drop-in Class” means a single pre-booked Class that is not offered as part of a Membership, and which is not a Taster Class.

 

Management” means the management of Zumba NXG for the time being.

Membership” means a paid monthly subscription to Zumba NXG entitling the subscriber (a “Member”) to a certain number of Classes per calendar month, depending on the type of Membership.

Membership Start Date” means the date chosen by you and agreed by us from which you start your Membership.

Online 5 Class Membership” means a Membership entitling the Member to five online Classes per calendar month.

Online 10 Class Membership” means a Membership entitling the Member to ten online Classes per calendar month.

“5 Class Membership” means a Membership entitling the Member to five Classes per calendar month.

“10 Class Membership” means a Membership entitling the Member to ten Classes per calendar month.

Taster Class” means a single pre-booked Class that is not offered as part of a Membership, and which is exclusively available to Clients who have never attended a Zumba NXG Class before.

Teamup” means goteamup.com, the website and online service of TeamUp Sports, Inc., the booking system used by Zumba NXG.

 

  1. CLASSES AND MEMBERSHIPS

 

  • ONLINE 5 CLASS MEMBERSHIP

The Online 5 Class Membership option entitles the purchaser to 5 online Classes per calendar month and costs £22.50 per month.

 

You will be billed every month, with no commitment to continue beyond the minimum term of one month. The first payment is due on the date of purchase and will be pro-rated.

 

Unless otherwise noted, this membership is non-transferable. Your payment details will be securely stored in our system for the duration of the Membership.

 

Cancellations require 14 days’ notice via email to zumbanxg@outlook.com.

 

  • ONLINE 10 CLASS MEMBERSHIP 

 

The Online 10 Class Membership option entitles the purchaser to 10 online Classes per calendar month and costs £40 per month.

 

You will be billed every month, with no commitment to continue beyond the minimum term of one month. The first payment is due on the date of purchase and will be pro-rated.

 

Unless otherwise noted, this membership is non-transferable. Your payment details will be securely stored in our system for the duration of the Membership.

 

Cancellations require 14 days’ notice via email to zumbanxg@outlook.com.

 

2.3 5 CLASS MEMBERSHIP

 

The 5 Class Membership option entitles the purchaser to five Classes per calendar month and costs £37 per month.

 

You will be billed every month, with no commitment to continue beyond the minimum term of one month. The first payment is due on the date of purchase and will be pro-rated.

 

 

Unless otherwise noted, this membership is non-transferable. Your payment details will be securely stored in our system for the duration of the Membership.

 

Cancellations require 14 days’ notice via email to zumbanxg@outlook.com.

 

2.4. 10 CLASS MEMBERSHIP

 

The 10 Class Membership option entitles the purchaser to ten Classes per calendar month and costs £63 per month.

 

You will be billed every month, with no commitment to continue beyond the minimum term of one month. The first payment is due on the date of purchase and will be pro-rated.

 

Unless otherwise noted, this membership is non-transferable. Your payment details will be securely stored in our system for the duration of the Membership.

  • ONLINE DROP-IN CLASSES

 

Online Drop-in Classes cost £7 per Class per household. Orders for Drop-in Classes expire one month after the purchase date.

 

  • DROP-IN CLASSES

 

Drop-in Classes cost £12 per class.

 

  • TASTER CLASSES

 

Taster Classes are free for a client’s first class at Zumba NXG.

 

  • CONCESSIONS

 

There may be concessions available for people who are dealing with significant financial difficulty due to the Covid-19 crisis. Concessions are granted at Zumba NXG’s sole and absolute discretion. Please email us at zumbanxg@outlook.com for details.

 

  • SINGLE DROP-IN CLASS POLICY

Class Credits for Taster Classes and single Drop-in Classes have an expiration date that is clearly stated on the sales receipt and/or your online account details and cannot be used after this date. Please note ‘expiration date’ is 31 days after the first use.  Any unused expired credits will not be refunded.  Exceptions may be made for medical reasons such as illness or injury with accompanying documentation at our discretion. Management reserve the right to refuse to grant credit extensions.

 

  • MEMBERSHIPS

All Memberships are non-transferrable.

  1. MEMBERSHIP FEES

Zumba NXG reserves the right to review and change Membership fees. We will give you 14 days written notice of any changes, and will obtain your consent to such changes before billing the updated amount. If your Membership comes to an end and you start it again, your new Membership fee will be charged at the prevailing rate at the time of the renewal. If you fall behind with your Membership fees and this is not caused by a bank error, we reserve the right to suspend or cancel your Membership.

 

  1. CANCELLATIONS AND REFUNDS

The cancellation and refund policy below applies to all purchases made from Zumba NXG including via the Zumba NXG Website (zumbanxg.com) and via Teamup.

 

  • CANCELLATIONS

 

You have the right to cancel any purchase from Zumba NXG (whether a Drop-in Class, Taster Class or Membership) within 14 days without giving any reason. The cancellation period will expire after 14 days from the date of purchase.

 

To exercise your right to cancel, you must inform us by email at zumbanxg@outlook.com.

 

To meet the cancellation deadline, it is sufficient for you to send your cancellation email before the cancellation period has expired.

 

  • REFUNDS

 

If you cancel your purchase, we will refund to you all payments received from you.

 

We will process the refund without undue delay, and not later than 14 days after the day on which we receive your cancellation email.

 

We will make the refund using the same means of payment as you used for the initial purchase, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the refund.

 

  1. MEMBERSHIP START DATE

Classes offered as part of a Membership subscription can only be booked from your Membership Start Date. We will bill you on the 1st of each calendar month, starting from the first full calendar month after your Membership Start Date.

 

Your Membership Start Date can only be changed once before your Membership starts.

 

  1. CLASS CANCELLATION / ACCOUNT CREDIT RETURN POLICY

Classes can only be booked using account credits or via one of the Membership / drop-in options. Once a class is booked, a credit is deducted from your account. Classes may be cancelled at least 20 minutes before the start of the class via the Teamup app or our website. Account credits will only be returned to your account for cancellations within policy. In the event Zumba NXG needs to cancel a class, we will attempt to contact all Clients via email who booked prior to cancellation and will return any credits to Clients who booked prior to cancellation. Clients and/or Members must ensure that they update their account with the correct contact information.

 

  1. EXTENSIONS

Members on the 5 Class Membership or the 10 Class Membership may extend the expiry of their Membership up to three times per calendar year for up to two weeks at a time. All Members will be given an automatic two-week extension on their December Classes to account for Christmas holidays.

 

  1. TEACHER SUBSTITUTION

Teachers may be substituted for another suitably qualified teacher at the discretion of Zumba NXG (“Teacher Substitution”).  As we are still providing a class with the same content and quality, refunds will not be granted in the event of Teacher Substitution.

 

  1. OUR COMMITMENT POLICY

Zumba NXG commits to holding a minimum of 12 Classes per calendar month.

 

  1. CONTRACT TERM

The minimum term for our Memberships is 1 month. You will pay a monthly fee (as per Membership option) which will debit your account automatically on the 1st of the month every month, commencing from your Membership Start Date.

 

  1. MEMBERSHIP FREEZE

You can freeze your Membership for a minimum term of one month. Membership freezes require 14 days notice. This notice MUST be given in writing by emailing zumbanxg@outlook.com.

 

  1. MEMBERSHIP CLASSES

Class credits must be used within each month of your contract, unless an extension is requested. Members may extend their Classes up to three times per calendar year for up to two weeks on each occasion.
